[Law Firm Now] Sejong to Hold 'Response Strategies to the Yellow Envelope Act' Seminar on August 6

A seminar will be held to discuss response strategies to the Yellow Envelope Act, which has gained significant momentum since the launch of the new administration.

Law firm Sejong (Managing Partner Oh Jonghan) announced on the 29th that it will hold an online seminar on August 6 at 3:00 p.m. under the theme of "Response Strategies to the Yellow Envelope Act."

The Yellow Envelope Act refers to the proposed amendments to Articles 2 and 3 of the Trade Union and Labor Relations Adjustment Act. The amendments aim to limit companies' claims for damages against striking workers and to strengthen the responsibilities of principal employers toward subcontracted workers. The amendments include provisions that would require principal employers to engage in collective bargaining with subcontractor unions if "substantial control" is recognized.

The name "Yellow Envelope Act" originated from an incident in December 2013, when a court recognized 4.7 billion won in damages against Ssangyong Motor (now KG Mobility) workers who had engaged in a prolonged strike. In response, a citizen delivered a yellow envelope containing 47,000 won to a media outlet to support the workers. The color yellow was traditionally used for salary envelopes when wages were paid in cash.

At the upcoming seminar, attorney Kim Jongsoo of Sejong will present on "Key Issues and Discussion Process of the Yellow Envelope Act," while attorney Cho Chanyoung will discuss "Criteria for Determining Principal Employer Status and Corporate Response Strategies."

Sejong stated, "It is time for fundamental consideration of the relationship between principal and subcontracted companies, and the efficient allocation of labor for production." The firm added, "This webinar will focus on the expansion of employer status, which is a key issue of the Yellow Envelope Act, and will provide specific interpretations and practical response strategies."

Kim Dongwook, head of Sejong's labor group, said, "If the Yellow Envelope Act is passed, it will bring about structural changes in Korea's labor-management relations. Through this webinar, we hope to provide direction on how principal employers can prepare for the Yellow Envelope Act and offer practical insights for redesigning the labor-management system."
