Plaintiff's Appeal Also Dismissed

Attorney Kim Moonhee (Judicial Research and Training Institute Class 34) of Yulchon LLC has been cleared of allegations of plagiarism regarding a statement related to the disclosure of personal information of 'cyber rekka' during a discovery request through a U.S. court. The court ruled that there was "no copyright infringement." The appeal by the plaintiff, who lost in the civil lawsuit, was also dismissed, effectively bringing the controversy to an end and clearing Yulchon of plagiarism suspicions.

The Seoul Central District Court Civil Division 306 (Presiding Judge Hwang Iljun) recently ruled against the plaintiff in a damages claim lawsuit filed by attorney Jung Kyungseok (Class 28) of Law Firm Riu against attorney Kim. Jung, representing the idol girl group IVE and Starship Entertainment, filed a discovery request with a U.S. court to obtain the personal information of YouTuber 'Taldeok Suyongso.' Jung claimed that Kim, representing another girl group NewJeans, filed a discovery request against YouTuber 'JungHakgyo7Haknyeon,' copying Jung's previously written statement by only changing the basic case information.

However, the court stated, "Except for the specific details of the case, Jung's statement does not differ significantly in content or format from other statements submitted for discovery requests, and is identical or similar to previously written documents." The court further noted, "Jung failed to clearly demonstrate his creative contribution to the format of the statement during its preparation," and added, "Based on the evidence submitted, it is difficult to recognize Jung as the author of the statement." The Gangnam Police Station in Seoul also decided not to refer the criminal complaint against attorney Kim to prosecution.
