542 Domestic and International Political Scientists: "Acting Chief Choi Sang-mok Must Be Immediately Appointed as Constitutional Court Justice"

"Restoring Constitutional Order and Stabilizing Governance Are the Top Priorities"

On the 30th, 542 political scientists demanded through a public statement that Choi Sang-mok, Acting Prime Minister and Minister of Strategy and Finance, promptly appoint the three constitutional court justices elected by the National Assembly.


Scholars researching and teaching political science at domestic and international universities and research institutes stated in the "Second Public Statement by Political Scientists Urging the Restoration of the Constitutional Order of the Republic of Korea" that "the most urgent task to restore the constitutional order of the Republic of Korea is for the Acting President to promptly appoint the three constitutional court justices recommended by the National Assembly so that the impeachment trial can proceed according to procedure, and to immediately promulgate the Special Investigation Act on Treason, which has already passed the National Assembly."


They emphasized, "Delaying this is tantamount to allowing the current dysfunction to continue, which not only damages national interests but also obstructs the restoration of the constitutional order and national stability. No demand or claim can take precedence over the appointment of constitutional court justices and the promulgation of the Special Investigation Act on Treason."

The political scientists stated, "At this point, concentrating all efforts on managing the Jeju Air passenger plane disaster, as well as swiftly overcoming the national crisis and restoring the constitutional order to stabilize state affairs, must be the top priority for the government and all national institutions and political forces."


They urged Acting President Choi to promptly appoint the constitutional court justices, immediately promulgate the Special Investigation Act on Treason, have the Constitutional Court request the government to appoint the justices, have the People Power Party restore itself as a responsible ruling and conservative party, and for President Yoon Seok-yeol to immediately comply with summons from investigative agencies.


Earlier, on the 8th, 573 political scientists also issued a public statement urging the prompt re-submission and passage of the impeachment motion to restore the constitutional order.

Second Public Statement by Political Scientists Urging the Restoration of the Constitutional Order of the Republic of Korea

Due to the treason caused by President Yoon Seok-yeol, the Republic of Korea is currently facing a national crisis. Although the entire nation stood up to block the emergency martial law declared on December 3rd aimed at destroying the democratic constitutional order, we are now witnessing continuous acts of national disorder by treasonous forces attempting to nullify these efforts. The most urgent task to restore the constitutional order of the Republic of Korea is for the Acting President to promptly appoint the three constitutional court justices recommended by the National Assembly so that the impeachment trial can proceed according to procedure, and to immediately promulgate the Special Investigation Act on Treason, which has already passed the National Assembly. Delaying this amounts to allowing the current dysfunction to continue, which not only damages national interests but also obstructs the restoration of the constitutional order and national stability. No demand or claim can take precedence over the appointment of constitutional court justices and the promulgation of the Special Investigation Act on Treason. The announcement by the Special Investigation Headquarters on December 27 confirmed that President Yoon Seok-yeol's emergency martial law constitutes treason and that the impeachment of President Yoon was a lawful and justified decision to protect Korean democracy and the republic. Since the Constitutional Court has already begun reviewing the impeachment motion passed by the National Assembly, there is no reason to delay the appointment of constitutional court justices and the promulgation of the Special Investigation Act on Treason. At this point, concentrating all efforts on managing the Jeju Air passenger plane disaster, as well as swiftly overcoming the national crisis and restoring the constitutional order to stabilize state affairs, must be the top priority for the government and all national institutions and political forces. Therefore, we political scientists urge the following: First, Acting Prime Minister Choi Sang-mok must remember that his duty as Acting President is to swiftly overcome the crisis through stable governance and immediately appoint the three constitutional court justices recommended by the National Assembly. Delaying the appointment of justices already agreed upon by the National Assembly while suddenly demanding new bipartisan agreements disregards the elected legislature and complicates the impeachment process, worsening national confusion. Second, the government must immediately promulgate the Special Investigation Act on Treason passed by the National Assembly. To prevent overlapping investigations, confusion, and unnecessary competition, it is necessary to conduct investigations through a special prosecutor, as was done during the impeachment of President Park Geun-hye. Thoroughly investigating the treason case and punishing those responsible through a special prosecutor is the best way to quickly stabilize state affairs. Third, the Constitutional Court must request the government to appoint the additional three justices and proceed with the impeachment trial swiftly and accurately. Conducting the impeachment trial with a full bench of nine justices is crucial for the trial's speed and legitimacy. The Constitutional Court is the last bastion of the constitutional order of the democratic republic. Since the purpose of the impeachment trial is to determine serious violations of the constitution and laws and the feasibility of continuing state governance, the Constitutional Court must make swift, clear, and decisive decisions based on evidence of national disorder secured by investigative agencies to prevent further division and confusion. Fourth, the People Power Party must promptly restore itself as a responsible ruling and conservative party. The party is currently adopting an anti-impeachment stance as its official position and attacking internal members who support impeachment, exhibiting anti-constitutional and anti-democratic behavior that fuels public anger. Instead of apologizing and reflecting on Yoon Seok-yeol's treason, the party is acting as if it condones treason by blocking the appointment of constitutional court justices and the promulgation of the Special Investigation Act on Treason. Now is a national crisis that requires setting aside partisan positions and pooling wisdom together. Fifth, President Yoon Seok-yeol must immediately comply with summons from investigative agencies. As a former Prosecutor General who emphasized equality before the law, President Yoon must sincerely cooperate with investigations into treason charges, the impeachment trial, and lawful procedures such as warrants, without any physical resistance involving the security office or any obstruction or delay, fulfilling his final duty to the people.
