Pretending to Be a Third Party in Unlicensed Drunk Driving

A man in his 40s who was caught driving under the influence without a license and gave his older sister's resident registration number was sentenced to a suspended prison term.


The Changwon District Court Criminal Division 1 (Presiding Judge Jeong Yuntaek) announced on the 6th that it sentenced Mr. A, in his 40s, who was indicted for violating the Road Traffic Act, to 1 year and 2 months in prison with a 2-year suspension. He was also ordered to complete 80 hours of community service and attend 40 hours of a safe driving lecture.

Mr. A was caught during a DUI checkpoint on the night of August 12 last year while driving on a road in Jinhae-gu, Changwon City, with a blood alcohol concentration of 0.147%, which is at the level of license cancellation.


He is accused of giving his older sister's resident registration number to the police officer and signing on the mobile information terminal. He also refused to acknowledge his blood alcohol concentration level and requested a blood test, but it was found that his older sister's signature was on the blood test confirmation as well.


The court stated, "He drove without a license while having a high blood alcohol concentration and used improper means such as impersonating a third party to conceal the crime," but added, "Considering that his personal information was discovered immediately after the crime, causing limited confusion in the investigation, and that he has children to support, the sentence was determined accordingly."
