A Man in His 20s Who Violated Court Orders and Stalked His Ex-Girlfriend Again... 'Suspended Sentence'

Court: "Considering that the victim does not wish to punish the defendant"

A man in his 20s was sentenced to probation for violating a court's provisional order issued in relation to a stalking crime.

[Asia Economy Reporter Yoon Seul-gi] A man in his 20s was sentenced to probation after violating a court's provisional order by approaching and contacting a stalking victim woman again.

The Jeonju District Court Criminal Division 2 (Presiding Judge Ji Yoon-seop) announced on the 14th that A (22), who was indicted for violating the Act on the Punishment of Stalking Crimes, etc. (non-compliance with provisional measures), was sentenced to 6 months in prison with 2 years of probation. He was also ordered to attend 40 hours of stalking treatment lectures and to undergo probation supervision.

The court stated, "The defendant violated the provisional order prohibiting contact with the victim, and it appears that the victim suffered mental distress and anxiety due to the defendant's actions."

However, the court explained the sentencing reason, saying, "Considering that the victim does not wish for the defendant's punishment and that the defendant has no criminal record exceeding a fine, the sentence was determined."

A was indicted for violating the court's provisional order by sending 17 messages and making 25 calls to his ex-girlfriend B from February 16 to March 1.

Investigations revealed that A caused mental distress to B by sending photos of self-inflicted injuries and continuously demanding meetings. When B did not respond, he went to her house, rang the doorbell, and knocked on the front door.

Earlier, after B notified him of their breakup, A committed stalking crimes by repeatedly sending messages with the intent of "If I can't have you, I will destroy you" from January 30 to February 1, resulting in the court issuing a provisional order.

However, after the prosecutor's indictment, B submitted a letter of non-prosecution to the court, and the stalking crime charges were dismissed.

Under current law, a person who commits stalking crimes is subject to imprisonment of up to 3 years or a fine of up to 30 million won. However, stalking crimes are offenses that cannot be prosecuted without the victim's consent.
