[Asia Economy Reporter Kim Hyung-min] Attorney Kim Ye-won of the Center for the Rights of Persons with Disabilities criticized the bill on the complete removal of prosecutorial investigation rights (Geomsu Wanbak), which passed the subcommittee of the National Assembly's Legislation and Judiciary Committee on the 26th, calling the provision that "prosecutors can investigate within the scope of the same criminal facts for cases referred to them" a "fatal poison clause," and demanded that "at least in prosecutorial supplementary investigations, the same restriction be removed."
According to the legal community on the 27th, Attorney Kim posted on her social media account the previous day, citing 20 examples to argue that the restriction on identity should be removed.
Attorney Kim first said, "Even if sexual violence is confirmed in a child abuse case, investigation cannot be conducted," and then added, "Even if child sexual exploitation material is found on a stalking perpetrator's phone, investigation cannot be conducted." She emphasized, "In a Junggonara fraud case, even if 100 more victims are identified, in a voice phishing collection case, even if the main culprit is discovered, in a 1 million won fraud case, even if a 10 billion won similar receipt or multi-level marketing case is revealed, and even if the driver is swapped, the real culprit cannot be investigated."
She also stated, "Even if a thief or serial killer confesses to additional crimes, investigation cannot be conducted; even if the true culprit of a murder is revealed; even if victims or witnesses suffer mysterious deaths or retaliatory crimes; even if embezzlement of union funds is uncovered in an apartment fraud case; and even if bribery payments are revealed in a bribery case, investigation cannot be conducted."
Furthermore, she said that in bribery cases where payments are revealed, in bribery acceptance cases where coercion is uncovered, even if a computer storing industrial technology is stolen, overseas technology leakage cannot be investigated. She added that if an illegal immigrant suspect is investigated and a spy is discovered, if a spy is investigated and a spy ring is confirmed, or if a drug user reveals manufacturing and distribution organizations, the same applies. Even if a marijuana smoker confesses to methamphetamine use, if a gambling offender is found to be a victim of fraud gambling, or if someone is cleared of false accusations, the crime of false accusation cannot be investigated either.
