Affixed Foundation Seal on International Golf School Documents While Pretending to Be Chairman
"Considered the Fact That No Substantial Damage Was Caused to the Foundation"
Park Juncheol, the father of former golfer Se Ri Park, has been sentenced to a suspended prison term for pretending to have authority as chairman of the Se Ri Park Hope Foundation and participating in the establishment of an international golf school.
Former golfer and broadcaster Seri Park is making a statement regarding her father's alleged forgery charges on June 18, 2024, at SpaceShare Samsung COEX Center in Gangnam-gu, Seoul.
On the 17th, Presiding Judge Kim Jiyeong of the Daejeon District Court's Criminal Division 6 announced that Park Juncheol, who was indicted on charges of forgery of private documents, use of forged documents, forgery of documents by impersonating a qualified person, and use of such forged documents, was sentenced to 10 months in prison, suspended for two years.
From June 2021 to July 2023, Park was accused of acting as if he had authority as chairman of the Se Ri Park Hope Foundation and affixing the foundation's seal to related documents at his discretion while promoting the establishment of the Saemangeum International Golf School.
After receiving a proposal to participate from a company seeking to establish the international golf school, Park submitted a letter of intent to administrative agencies and proceeded with agreements between companies, despite not having been granted any authority or position by the Se Ri Park Hope Foundation.
Upon learning of these actions, the Se Ri Park Hope Foundation filed a complaint against Park with the police in September 2023. Park argued that he acted for Se Ri Park's benefit and claimed to have received implicit authorization from the foundation, but this was not accepted.
The court explained that Park did not have legitimate authority to draft documents in the name of the foundation, and it could not be assumed that the foundation, as the named party, would have naturally consented upon learning of the project.
Presiding Judge Kim Jiyeong stated, "The defendant appears to have proceeded with this case despite knowing he lacked legal authority," adding, "However, the documents he created were letters of intent or confirmations of facts, which are not considered documents imposing legal obligations on the foundation, and it appears that no substantial damage was caused to the foundation. These factors were taken into consideration."
