On December 7, the special prosecutor's team led by Cho Eun-seok, which is investigating the rebellion and treason allegations related to the December 3 Martial Law, announced this at a briefing. Special Prosecutor Park Ji-young stated, "Today, Assemblyman Choo was indicted without detention on charges of engaging in important duties related to rebellion, specifically for obstructing the December 3 Martial Law vote."

Choo is accused of, as the ruling party’s floor leader, receiving a request from former President Yoon Suk-yeol’s side to cooperate with the martial law declaration last year and subsequently obstructing other lawmakers from participating in the vote to lift martial law.

After the martial law was declared, he convened an emergency party meeting and changed the venue three times, alternating between the National Assembly and the party headquarters.

The special prosecutor’s team requested an arrest warrant for Choo on November 3, but after holding a pretrial detention hearing on December 2, the court dismissed the request the following morning, stating there was room for dispute regarding the charges and legal interpretation.
