Special Prosecutor Indicts Former President Yoon on Additional Charges of False Testimony Over Cabinet Meeting Circumstances

As the special prosecutor team led by Cho Eunsuk has additionally indicted former President Yoon Suk-yeol on charges of perjury in connection with the 12·3 Martial Law document allegations, the case has been assigned to the Criminal Agreement Division 32 (Presiding Judge Ryu Kyungjin) of the Seoul Central District Court.

According to the legal community on December 5, the Seoul Central District Court has assigned the case involving former President Yoon to the relevant division. The Criminal Division 32 is currently handling cases such as the one against former Minister of the Interior and Safety Lee Sangmin, who is charged with participating in a major insurrection, and the stock price manipulation case of former Wellbiotech CEO Koo Sehyun, which was prosecuted by the special prosecutor Kim Keonhee.


Former President Yoon is accused of giving false testimony regarding the circumstances of convening the Cabinet meeting while appearing as a witness in the trial of former Prime Minister Han Ducksoo, who is charged with aiding and abetting insurrection, which took place last month.


According to the special prosecutor team, former President Yoon testified at the time that "the Cabinet meeting was planned in advance," claiming that preparations for the meeting had already been made before former Prime Minister Han's proposal. However, the special prosecutor believes that former President Yoon had no intention of convening the Cabinet meeting until he received Han's proposal, which was intended to create an appearance of legality, and only then decided to call the meeting.


The special prosecutor determined that this testimony was false and indicted former President Yoon on charges of perjury. Since its launch in June, Cho Eunsuk's special prosecutor team has been investigating the responsibility of key military and Blue House officials for conspiring and executing insurrection, and related cases are now entering full-scale judicial proceedings.


In addition to former President Yoon, trials have also been assigned for former officials indicted on charges such as drafting documents to justify martial law after the fact, controlling the media, and obstructing investigations. The case of Kang Uigu, former Presidential Secretary's Office Chief, has been assigned to Criminal Agreement Division 30 (Presiding Judge Park Okhee). Kang is accused of drafting false documents related to martial law after the fact and managing them as presidential records.


Lee Eunwoo, former President of the Korea Policy Broadcasting Foundation (KTV), will be tried by Criminal Agreement Division 23 (Presiding Judge Oh Seyong). Lee is accused of abusing his authority and obstructing the exercise of rights by ordering the deletion of politicians' remarks stating that "martial law is unconstitutional and illegal" from broadcast subtitles immediately after the declaration of martial law.


Meanwhile, the case involving Park Jongjun, former Chief of the Presidential Security Service, and others, who have been indicted on charges of obstructing the execution of an arrest warrant for former President Yoon requested by the Corruption Investigation Office for High-ranking Officials, has been assigned to Criminal Agreement Division 26 (Presiding Judge Lee Hyunkyung).
