Seongnam City Expects Increased Redevelopment Feasibility Following Amendment to Military Base Act Enforcement Decree

Easing of Height Restrictions Expected to Boost Household Numbers
and Reduce Residents' Financial Burden in Seongnam Redevelopment Zones

Seongnam City in Gyeonggi Province (Mayor: Shin Sangjin) announced on the 21st that, following the approval of the amendment to the Enforcement Decree of the Military Base and Military Facilities Protection Act at the Cabinet meeting on the 18th, the easing of unreasonable height restriction regulations is expected to enhance the business feasibility and increase the number of households in redevelopment zones such as Sujin 1 District and Sinhung 1 District.

This amendment removes the phrase "the lowest part" from "the lowest part of the ground surface among the parts to be used as a site," as stipulated in Annex 5 of the Enforcement Decree.


Previously, when constructing on a slope, the height restriction was applied based on the lowest point, which significantly limited the number of floors that could be secured. From now on, a more reasonable standard has been established, making it easier to promote redevelopment projects.


To address this issue, Seongnam City launched a study on relaxing height restrictions in September 2023 and prepared five mitigation plans, including changing the ground surface standard in Annex 5 of the Enforcement Decree, by September 2024.


Furthermore, on June 26 this year, the city sent official documents to the Ministry of National Defense and the Air Force requesting a relaxation of height restrictions and has continued to make such proposals. This amendment is regarded as the result of these policy efforts leading to improvements in the central government's regulations.


A Seongnam City official stated, "This regulatory relaxation will serve as a turning point for revitalizing redevelopment and reconstruction. We expect increased business feasibility due to a rise in the number of households and a reduction in residents' cost burden." The official added, "We will continue to seek a balance between military facilities and citizens' residential rights and work closely with the central government."
