Dismissal for Workplace Harassment... Gwangju Volunteer Center Director Loses Lawsuit

Gwangju District Court: "Both Procedures and Reasons Are Justified"
Central Labor Relations Commission Also Dismisses Unfair Dismissal Relief Request

The director of the Gwangju Volunteer Center, who was dismissed for reasons including workplace harassment, filed a lawsuit seeking to invalidate the dismissal, but the court did not accept the claim.

The 14th Civil Division of the Gwangju District Court (Presiding Judge Lim Sol) announced on the 16th that it had dismissed the plaintiff's claim in the lawsuit filed by Mr. A against the Gwangju Volunteer Center seeking confirmation of invalid dismissal.


The court stated, "The disciplinary procedures were lawful, all grounds for disciplinary action are recognized, and the severity of the disciplinary measure is appropriate," adding, "The plaintiff's argument that the dismissal is invalid is without merit."


Mr. A was dismissed in October 2023 after being referred to the personnel committee for reasons including workplace harassment, issuing unlawful orders, and poor attendance while serving as director of the Volunteer Center. The Gwangju Volunteer Center received several grievance reports from employees, conducted a fact-finding investigation, and then imposed disciplinary action.


Mr. A argued, "I did not abuse my authority to force unfair tasks, and the employees helped voluntarily," but a previous application to the Central Labor Relations Commission for relief from unfair dismissal was also dismissed.
