The U.S. Federal Court of Appeals has ruled that the reciprocal tariffs imposed by President Donald Trump will remain in effect until the appellate court completes its substantive review of the case.


On June 10 (local time), The Wall Street Journal (WSJ) reported that the U.S. Court of Appeals is scheduled to hold a hearing on July 31, meaning the reciprocal tariffs will remain in effect for at least two more months. This decision follows the court's acceptance of the Trump administration's emergency request to stay the lower court's ruling on May 28, and now, once again, the court has decided to extend the reciprocal tariffs.


As a result, President Trump can continue to negotiate with other countries without the risk that the reciprocal tariff measures will be nullified by the court while the appeal is ongoing.


The Court of International Trade (CIT) previously ruled that the exclusive authority to impose reciprocal tariffs lies with Congress, and on May 28 ordered the withdrawal of the tariffs imposed by President Trump under the International Emergency Economic Powers Act (IEEPA). The case is currently pending before the appellate court, and the final decision is expected to be made by the U.S. Supreme Court. The U.S. Supreme Court currently has a 6-3 conservative majority, which has generally shown a favorable stance toward President Trump.
