Tariff Measures to Remain in Effect Pending Appeal
The United States Court of Appeals temporarily suspended the effect of a lower court ruling that had partially invalidated President Donald Trump's tariff measures. As a result, all tariff measures implemented by the Trump administration will remain in effect while the appeals process is ongoing.
On May 29 (local time), the U.S. Court of Appeals accepted the Trump administration's request for an injunction and decided to maintain the effect of tariffs imposed under the International Emergency Economic Powers Act (IEEPA), which had been invalidated by the lower court the previous day.
Previously, the U.S. Court of International Trade had ruled that a series of tariff measures imposed by President Trump based on the IEEPA exceeded his legal authority and were therefore unlawful. As a result of this ruling, there was a high possibility that the so-called "Liberation Day tariffs"?a 10% base tariff on imports worldwide?and the country-specific reciprocal tariffs scheduled to take effect after a 90-day grace period would be invalidated.
In response, the Trump administration filed an appeal and requested an injunction to suspend the effect of the lower court's ruling. With the appellate court granting this request, the relevant tariff measures will remain in place for the time being.
