Supreme Court Finalizes Prison Sentence After Suspended Term Revoked
A man in his 30s was sent to prison after committing additional offenses during his probation period. He was reportedly given a suspended prison sentence for charges including special assault.
According to Yonhap News on May 2, citing the Incheon Probation Office of the Ministry of Justice, the court approved a request to revoke the suspended sentence of Mr. A (30), who was under probation. The Supreme Court recently finalized the prison sentence.
Mr. A was indicted in November 2022 on charges of special intimidation and special assault. The Gwangju District Court sentenced him to one year and six months in prison, suspended for three years, along with an order for probation.
However, during his probation period, Mr. A committed 14 additional offenses, including driving without a license and assault, and failed to comply with summonses from his probation officer. As a result, the court issued an arrest warrant. He was taken into custody when he appeared at the police station for an assault case, and the court revoked his suspended sentence and imposed a prison term.
There are similar cases. In February last year, Mr. B (54), a Taiwanese national, was sentenced to a suspended prison term by the Seoul High Court for charges including retaliatory assault under the Act on the Aggravated Punishment of Specific Crimes. However, during his probation period, he failed to comply with various requirements and was recently sentenced to prison.
Mr. B reportedly left his registered residence with the Incheon Probation Office and concealed his whereabouts, leading the court to issue an arrest warrant.
Meanwhile, a probation order allows an offender to live freely in society under certain conditions instead of being incarcerated. Probation officers, who are government officials, provide guidance, supervision, and support to promote healthy reintegration into society and prevent recidivism. This is a criminal justice system aimed at rehabilitation.
The length of the probation period varies depending on the classification of the individual under probation. Those under probation must comply with the requirements set by their probation officer and strive to become responsible members of society. If a person under probation violates these requirements, or if there is sufficient reason to believe that a violation may occur, the probation officer may urge compliance, and the individual may face adverse measures such as the execution of the original sentence.
