Min Hyungbae, a member of the National Assembly from Gwangsan-eul, Gwangju, representing the Democratic Party of Korea, announced on the 7th that he had proposed the "Special Act on the Punishment of Anti-Constitutional Actors Related to the 12.3 Martial Law."
This bill was drafted with the intention of punishing those who led, participated in, aided, or incited the anti-constitutional acts related to the 12.3 Martial Law, and to prevent recurrence by clarifying the facts surrounding these acts.
The special act includes provisions for establishing a Special Committee for the Investigation of Anti-Constitutional and Rebellion Acts under the direct supervision of the Speaker of the National Assembly, as well as regulations for punishing acts that support rebellion, such as spreading false information related to the 12.3 incident.
The Special Committee for the Investigation of Anti-Constitutional and Rebellion Acts will carry out tasks such as: ▲clarifying the facts of anti-constitutional acts ▲investigating the spread of false information ▲hearing statements from victims of anti-constitutional acts ▲researching measures to prevent recurrence of rebellion. The committee may operate for one year, with the possibility of annual extensions by resolution of the National Assembly. Based on the committee's findings, the National Investigation Headquarters is required to immediately investigate the facts uncovered and report to the committee every six months.
The special act also includes provisions prohibiting the spread of false information and stipulates penalties. Those who directly led the 12.3 Martial Law, or even those who did not participate but spread false information about anti-constitutional acts online or through street speeches, may be sentenced to up to five years in prison or fined up to 50 million won.
Min emphasized, "Punishing anti-constitutional actors is the most urgent task, alongside the impeachment of the rebellion ringleader Yoon Sukyeol. If we do not fully reveal and hold accountable those who destroyed democracy, someone may once again choose rebellion. Together with the sovereign citizens, we will uncover the truth and strictly punish anti-constitutional actors."
