Rulings on Constitutional Petitions and Other Cases to Be Delivered Before Retirement
Cho Ji-ho and Son Jun-seong Cases Expected to Be Concluded After Retirement
The Constitutional Court, which ruled to dismiss former President Yoon Seok-yeol, is preparing to deliver rulings on remaining cases such as constitutional petitions and constitutional review of laws next week.
According to the legal community on the 5th, the Constitutional Court plans to deliver rulings on general cases including constitutional petitions and constitutional review of laws on the 10th. Since Acting Chief Justice Moon Hyung-bae and Justice Lee Mi-seon will retire on the 18th, the court aims to conclude cases whose hearings have been completed before then.
There is also a possibility that the impeachment trial of Minister of Justice Park Seong-jae, whose oral arguments have concluded, will be decided on the 10th. Minister Park was impeached by the National Assembly on December 12 for not opposing the declaration of emergency martial law on December 3 and for discussing follow-up measures to the emergency martial law with former Minister of the Interior and Safety Lee Sang-min and others at a safe house in Samcheong-dong after the martial law was lifted.
The remaining impeachment trials of Police Commissioner General Cho Ji-ho and Prosecutor Son Jun-seong are expected to be concluded after Acting Chief Justice Moon and Justice Lee retire, as the procedures have not yet been completed. The impeachment case against Commissioner Cho has not even had a preparatory hearing, and the case against Prosecutor Son is currently suspended due to a criminal trial.
Meanwhile, it has been reported that the justices are resting at home without any special schedules over the weekend. Since the National Assembly passed the impeachment motion against former President Yoon Seok-yeol on December 14 last year, the justices have been tightly managing schedules including preparatory hearings, oral arguments, and deliberations. It is known that immediately after delivering the ruling on former President Yoon’s impeachment trial the previous day, all justices left the court building for personal safety. The Constitutional Court also plans to open the annex briefing room, which was operated daily during the trial period, only on ruling and oral argument days as usual going forward.
