Prosecutors Who 'Immediately Dropped Appeal' Against Yoon's Detention Cancellation Say "No Change in Position" Yonhap News

On the 13th, the Supreme Prosecutors' Office issued a statement saying, "There is no change in the prosecution's position."

The Supreme Prosecutors' Office stated, "Whether to contest the cancellation of detention falls within the scope of the prosecution's duties," adding, "Since the Prosecutor General made a quasi-judicial decision after thoroughly listening to the investigation team and the Supreme Prosecutors' Office chiefs' meeting and careful consideration, it must remain unwavering against any external influence."

They also reiterated their intention to rectify the matter in the main trial. The Supreme Prosecutors' Office explained, "Although the court's recent decision regarding the calculation of the detention period is unfair and contrary to long-established practices, the prosecution decided not to file an immediate appeal, taking into account the Constitutional Court's previous ruling deeming immediate appeals related to personal detention unconstitutional, and the court's judgment that even if there is no problem with the detention period, there should be no doubt about the legality of the investigation process, and will correct the issue in the main trial."

They added, "We will discuss with relevant agencies a prompt plan to revise related regulations to avoid legal interpretation controversies and unconstitutionality regarding the method of calculating the detention period and the immediate appeal system related to detention cancellation."
