Police Special Investigation Unit Rejects 'Yoon Arrest Delegation'... Acknowledges Legal Flaws in Corruption Investigation Office

President's Office, Party, Government, Military, Police, and 49 Individuals Booked

On the 6th, the police rejected the High-ranking Officials' Crime Investigation Agency's (HCIA) official letter delegating the execution of President Yoon Seok-yeol's arrest warrant, citing legal defects.

Baek Dong-heum, Deputy Head of the National Investigation Headquarters' Special Investigation Unit for Martial Law, stated at a briefing in the afternoon, "After internal legal review, we determined that the HCIA's execution command letter has legal controversies," adding, "We will continue to consult with the HCIA regarding the execution of the arrest warrant."


According to the Special Investigation Unit, around 7 a.m., they received an official letter from the HCIA titled 'Execution Command for Arrest and Search Warrants.' The letter cited Article 47 of the HCIA Act, Articles 81, 291, 200-6, and 115(1) of the Criminal Procedure Act as grounds for delegating the execution of the arrest warrant to the police. A Special Investigation Unit official explained, "There has never been a case where the police executed a warrant issued to the prosecution on their behalf."


The Special Investigation Unit official stated, "The HCIA is clearly the entity responsible for executing the arrest warrant," and added, "The cooperative investigation system will not be shaken."


Currently, 49 individuals have been registered as suspects in connection with the December 3 martial law incident, including 25 personnel from the Presidential Office, ruling party, and government, 19 military personnel, and 5 police officers.
