The police are facing setbacks in their investigation as the prosecution has not requested search warrants applied for in connection with the 'December 3 Emergency Martial Law Incident.'
According to the Special Investigation Unit of the National Police Agency on the 11th, search warrants were applied for the Presidential Office, National Police Agency, Seoul Metropolitan Police Agency, National Assembly Security Service, Special Warfare Command, and Capital Defense Command. However, the prosecution did not request warrants for the Special Warfare Command and Capital Defense Command.
Under current law, due to the adjustment of investigative authority between the prosecution and police, only the police can investigate the crime of rebellion. However, the High-ranking Officials' Crime Investigation Agency (HOCI), prosecution, and police are currently competing over the investigation of the emergency martial law incident.
Opposition party lawmakers from the National Assembly's Administration and Security Committee met with Woo Jong-su, head of the Special Investigation Unit, on the 9th. On that day, Yoon Geon-young, a member of the Democratic Party of Korea, mentioned former Minister of National Defense Kim Yong-hyun's voluntary appearance before the prosecution and the timing of the police search, stating, “I heard that there are practical difficulties with the warrant application system. There were several proposals to overcome this.”
