Asiana Pilot Union's Injunction Request Dismissed
The court rejected the claim of the Asiana Airlines Pilots Union, which demanded a suspension of the decision to sell Asiana Airlines' cargo business?a condition for the approval of the corporate merger between Korean Air and Asiana Airlines?arguing that the decision was unfair.
According to the aviation industry and legal circles on the 22nd, the Seoul Southern District Court Civil Division 51 (Chief Judge Kim Woo-hyun) dismissed the provisional injunction application filed by the Pilots Union against Asiana Airlines on the same day.
Dismissing a case is a procedure that concludes the case without substantive judgment when the plaintiff's claim does not meet the legal requirements.
Earlier, on the 28th of last month, the Pilots Union filed a provisional injunction application with the court, seeking to nullify the board resolution approving the sale of Asiana Airlines' cargo division.
They had previously argued that the exercise of voting rights by outside director Yoon Chang-beon, a legal advisor at Kim & Chang law firm, was inappropriate during the Asiana Airlines board meeting on November 2 of last year, when the sale resolution was made.
