As the controversy over 'marital rape' between broadcaster Park Ji-yoon and Choi Dong-seok erupted and Choi was accused, the police investigation into the allegations was closed without indictment.
On the 11th, according to the Jeju Special Self-Governing Province Police Agency, the Women and Juvenile Division sent a non-indictment decision notice to netizen A, who reported Choi Dong-seok through the National Police Agency's online complaint system. The police stated, "The investigation before indictment is concluded due to insufficient evidence." Afterwards, A disclosed a phone conversation with the team leader in charge of the Women and Juvenile Division on an online community. The police explained, "Park Ji-yoon herself responded that she would report again to the investigative agency if necessary," adding, "We made the non-indictment decision because we do not know the specific details of the damage without receiving a statement." They continued, "Since there is currently no indictment, if a formal complaint or accusation is filed with the investigative agency, we can open a case and investigate according to the Criminal Procedure Act or investigation regulations," and added, "If Park Ji-yoon submits a complaint or formal procedure that meets the prosecution conditions to the investigative agency, we can naturally investigate."
Earlier, on the 17th of last month, entertainment media Dispatch reported the message exchanges and recordings between the two, conveying both parties' positions on the divorce. Among these, it became known that Park Ji-yoon asked Choi Dong-seok, "Can I tell the child that 'your father tried to assault me'?" which caused a stir. At that time, Choi responded, "That can happen between a married couple," while Park Ji-yoon rebutted, "Marital rape can be established even between spouses."
In response, A submitted a complaint titled, "The police must thoroughly investigate the marital rape case of Park Ji-yoon and Choi Dong-seok and strongly urge strict punishment if criminal charges are found," to the National Police Agency's online complaint system. A argued, "While the state's intervention in the sexual life between spouses should be minimized from the perspective of maintaining the family, since Park Ji-yoon, a former KBS announcer, and Choi Dong-seok have entered divorce mediation, it seems they have already fallen outside the scope of a normal family," adding, "Especially since the reality of rape has been revealed through Dispatch, it is necessary to clearly examine whether Choi Dong-seok fundamentally violated Park Ji-yoon's sexual self-determination rights."
Meanwhile, Park Ji-yoon and Choi Dong-seok, who joined KBS as announcers in the 30th class, married in November 2009 and have one son and one daughter. They announced their breakup last October after 14 years of marriage. Subsequently, in June, Park Ji-yoon filed a claim for damages for alienation of affection against Choi Dong-seok's female acquaintance A, and Choi also filed a countersuit against Park Ji-yoon's male acquaintance.
