Prosecutors Appeal First Trial Verdict for Uncle Convicted of Sexually Assaulting Niece with Intellectual Disabilities Daejeon District Prosecutors' Office Cheonan Branch

The prosecution has appealed the first trial verdict that sentenced an uncle-in-law to nine years in prison for sexually assaulting his intellectually disabled niece.


According to the legal community on the 1st, the Cheonan Branch of the Daejeon District Prosecutors' Office submitted an appeal to the court the previous day against the first trial verdict that sentenced Mr. A (52) to nine years in prison on charges including quasi-rape by a relative under the Act on Special Cases Concerning the Punishment of Sexual Crimes.


Previously, on the 28th of last month, the 1st Criminal Division of the Cheonan Branch of the Daejeon District Court (Presiding Judge Jeon Kyungho) stated, "The Criminal Act stipulates strict punishment of life imprisonment or at least seven years in prison for sexual crimes against persons with disabilities or relatives," and sentenced Mr. A to nine years in prison, an order to complete a treatment program, disclosure of personal information, an order to complete 80 hours of sexual violence treatment, and a seven-year employment restriction.


Mr. A was charged with sexually assaulting his intellectually disabled niece six times and molesting her three times inside his truck between 2021 and 2023.


Mr. A tried to conceal his crime by telling his niece, "Never tell your mother," and continued to commit the crime even after writing a written pledge when the sexual assault was discovered.


The prosecution stated the reason for the appeal, saying, "The victim and her mother are still suffering from shock, and they are petitioning for a severe punishment for the defendant, so it is necessary to impose a heavier sentence on the defendant."
