Prosecutor's Investigation Finds Secondary Harm to Victims Due to 'Private Sanctions'
A YouTuber who produced and released videos containing false information about the perpetrator of a sexual assault case that occurred 20 years ago in Miryang, Gyeongnam, has been brought to trial.
The Criminal Division 1 of Daegu District Prosecutors' Office (Chief Prosecutor Won Hyung-moon) announced on the 30th that they have indicted a man in his 30s, Mr. A, without detention on charges of violating the Information and Communications Network Act (defamation), insult, and violation of the Stalking Punishment Act.
Mr. A is accused of publishing numerous videos containing false information related to the Miryang sexual assault case perpetrator and the Sinan salt farm slavery case on his YouTube channel from July 2023 to last June, causing privacy invasion and defamation damages.
He is also charged with threatening and insulting by calling certain subscribers who had conflicts with him or individuals appearing in the videos and using abusive language.
During the prosecution investigation, Mr. A claimed that he produced and distributed the videos for public interest, but the investigation revealed that the defendant posted content without the victims' consent under the pretext of 'private punishment,' causing secondary harm to the parties involved. The prosecution stated, "We will strictly respond to cyberwrecking crimes that generate profits based on false information or others' weaknesses."
