Osiria Complex Residential Accommodation Buyers Report Rally Demanding Change of Use

Held in front of Busan Urban Corporation from August 26 to September 20

Busan Urban Corporation announced on the 26th that the partial owners of the Osiria Tourism Complex residential lodging facility submitted a protest notification to the local police station on the 22nd, demanding a change of use for the residential lodging facility to a residential officetel.


The site for the Tower Residence in the Osiria Tourism Complex, located in Gijang-eup, Gijang-gun, is designated for the construction of a residential lodging facility, which must be registered as an accommodation business and operated as a rental property. After the supply contract, it was sold in 2019, completed in March 2022, and is currently operating as 'Osiria Switzen Mathieu.'


In 2021, as cases of illegally converting residential lodging facilities into residential spaces increased, the Ministry of Land, Infrastructure and Transport implemented a policy to encourage changing the use of already sold residential lodging facilities to residential officetels or housing.


Since July 2023, the partial owners of the Osiria Tourism Complex residential lodging facility have requested that the facility's use be changed to a residential officetel in accordance with the Ministry's policy.


In response, Busan City and Busan Urban Corporation notified that the change of use was not possible for the following reasons: ▲ According to the 'Tourism Promotion Act' of the Ministry of Culture, Sports and Tourism, which is the legal basis for the tourism complex development project, the introduction of residential facilities within the tourism complex is not permitted; ▲ The project approval conditions explicitly state that independent residential facilities cannot be installed within the tourism complex, and there should be no cases of operating independent residential facilities together; ▲ Since officetels are classified as quasi-residential facilities that can be used as residential spaces, there is concern that a change of use would turn them into residential facilities.


Busan City and Busan Urban Corporation stated, "Within the current legal framework, there is no way to resolve the request for a change of use, so we will review whether there are possible improvements, such as easing the registration requirements for accommodation businesses and improving the registration and operation of accommodation businesses."


The protest is scheduled to take place in front of Busan Urban Corporation for about a month, from the 26th to September 20th.
