Appellate Court: "Considering Victim Agreement and No Desire for Punishment"
In the appellate trial for a teenager who kidnapped and sexually assaulted a woman on her way home, a sentence of 7 years for the long-term and 5 years for the short-term was handed down.
A teenager who kidnapped, sexually assaulted, and robbed cash from a woman in her 40s while she was on her way home received a reduced sentence in the appellate court.
The Daejeon High Court's 3rd Criminal Division (Chief Judge Kim Byeong-sik) sentenced A (16) to 7 years as the maximum term and 5 years as the minimum term on the 14th in the appellate trial for charges including robbery-rape and robbery-assault.
Additionally, the court ordered 80 hours of sexual violence treatment lectures and a 5-year employment restriction at institutions related to children, adolescents, and persons with disabilities.
The court explained the sentencing rationale by stating, "Considering that the victim expressed a desire not to punish after reaching an agreement and that the family sold their house to settle the matter."
A was prosecuted for approaching a woman in her 40s on her way home in Nonsan, Chungnam, last October by saying, "I will take you on my motorcycle," then taking her to an elementary school and sexually assaulting her.
The first trial court sentenced him to 10 years as the maximum term and 5 years as the minimum term, stating, "The crime was serious, and the victim showed extreme fear and anxiety."
