Appeal Filed Against Suspended Sentence for 60s Boss Convicted of Sexual Crime Against Sleeping Female Employee

Sentenced to 1 Year and 6 Months Imprisonment with 3 Years Probation
Appealing the First Trial Verdict to the Court

A 60-year-old business owner who was arrested and prosecuted for attempting to sexually assault a 50-year-old employee who fell asleep at the PC room he operated was sentenced to a suspended prison term and released after paying a settlement of 27 million won and showing remorse.

On the 12th, the Criminal Division 1 of the Wonju Branch of Chuncheon District Court (Chief Judge Lee Su-woong) sentenced Mr. A (63), who was arrested and prosecuted on charges of attempted rape, to 1 year and 6 months in prison with a 3-year suspension. Along with this, he was ordered to attend 40 hours of sexual violence treatment lectures and was banned from employment at institutions related to children, adolescents, and persons with disabilities for 3 years each.

In March of last year, Mr. A lay down next to employee Ms. B (53, female), who was sleeping beside the counter at a PC room in Wonju City that he operated, and touched several parts of her body. He was also charged with climbing on top of Ms. B and attempting to rape her by removing her lower garments.

The crime was interrupted when Ms. B, sensing something suspicious, shouted that she needed to go to the restroom and escaped, resulting in an attempted offense.

The court stated, "The defendant attempted to rape the victim but failed as the victim shouted and escaped. Considering the circumstances and method of the crime, the nature of the offense is serious, and the victim is believed to have suffered considerable sexual discomfort and psychological shock from this incident." The court continued, "Taking into account that the defendant admitted the crime and showed remorse, has no prior record of sexual offenses, paid 27 million won to the victim, reached a settlement, and that the victim does not wish to pursue punishment, the sentence was determined accordingly."

Mr. A’s side has filed an appeal against the first trial verdict with the court.
