The court has ruled that the amount of agricultural loss compensation resulting from road expansion construction or housing development projects is not personal information and must be disclosed.
According to the legal community on the 23rd, the Administrative Court of Seoul, Administrative Division 11, partially ruled in favor of plaintiff A, the representative of an agricultural corporation, in a lawsuit against Korea Land and Housing Corporation (LH) seeking cancellation of the refusal to disclose information.
A, who was cultivating Sanghwang mushrooms in the Goyang-si area of Gyeonggi Province, applied for agricultural loss compensation when the mushroom cultivation site was included in LH's road expansion project in 2021. However, as the compensation amount paid was less than expected, A filed an information disclosure request with LH, demanding the disclosure of locations and amounts compensated during the housing development project construction and road expansion and paving works conducted around 2018. In particular, A requested the disclosure of compensation amounts and calculation bases for places cultivating Sanghwang mushrooms like his own farm.
However, when LH refused to disclose the information, citing concerns that it might infringe on the privacy or freedom of the information subjects, A filed an administrative lawsuit in objection.
The court ruled in favor of A, stating that disclosing the information would not infringe on the privacy or freedom of the compensated individuals. The court stated, "The information the plaintiff seeks to disclose does not include personal details such as names, contact information, resident registration numbers, or addresses," and added, "Even if disclosed, it is unlikely to infringe on the privacy or freedom of the compensated individuals."
