County Council Grade 5 Promotion, Forced Training, Violation of Personnel Agreement
Uiryeong-gun, Gyeongnam Province announced on the 15th that it has terminated the "Agreement on Personnel Affairs between Uiryeong-gun and Uiryeong-gun Council," which had been concluded and operated with the Uiryeong-gun Council, after the council unilaterally violated the agreement twice regarding grade 5 promotions and training.
Uiryeong-gun stated that since the end of 2023, the council unilaterally pushed forward with grade 5 promotion personnel matters and leadership training courses, making it inevitable to terminate the agreement.
With the termination of this agreement, three Uiryeong-gun officials who were dispatched and working at the Uiryeong-gun Council will return, and personnel exchanges will be suspended. The council must independently manage areas such as training and welfare.
To establish the council’s personnel authority early and support efficient institutional operation, Uiryeong-gun and the Uiryeong-gun Council signed the "Agreement on Personnel Affairs" in January 2022. Under this agreement, council staff were dispatched from Uiryeong-gun, and personnel exchanges, training, welfare, and overtime system operations were integrated and supported by Uiryeong-gun.
However, ahead of the regular personnel appointments in the first half of 2024, the council unilaterally violated the agreement regarding personnel matters.
According to Articles 3 and 8 of the agreement, both institutions must hold personnel committees after mutual consultation on △ the number of possible promotions per institution, △ staffing by rank, and △ extension and return of dispatched employees. Nevertheless, on December 29, 2023, the Uiryeong-gun Council unilaterally held its own personnel committee based on Article 103, Paragraph 2 of the Local Autonomy Act, which grants the chairperson of the local council authority over appointment, education, training, service, and discipline, and carried out grade 5 promotions.
Furthermore, although Article 3(b) of the agreement stipulates that the council’s employee training should be integrated and operated by Uiryeong-gun, the council unilaterally applied to Gyeongsangnam-do (Personnel Division) on January 24, 2024, for leadership training for grade 5 promotees without any consultation with Uiryeong-gun, thereby violating the agreement between the two institutions.
The county raised objections several times to the council’s failure to comply with the agreement, but the council repeatedly insisted on its "own personnel authority."
A county official stated, "The termination of this agreement is the county’s decision against the council’s unilateral personnel management, and the council should reflect on whether it has faithfully fulfilled its roles and responsibilities appropriate to its position."
