"My Novel Used for AI Training"…NVIDIA Also Faces Lawsuit

Copyright Lawsuits Over Generative AI Continue... NYT and OpenAI Also Involved

NVIDIA has been sued for allegedly using novels without permission to train its artificial intelligence (AI) platform 'NeMo,' major foreign media reported on the 10th (local time).


Writers Brian Keene, Abdi Nazemian, and Stewart O'Nan claimed that their works were included in a dataset of 196,640 books used to train NeMo, and filed a class-action complaint in the U.S. District Court in San Francisco on the 7th. The dataset was deleted following copyright infringement reports.

They argued that deleting the dataset after the copyright infringement report was an acknowledgment by NVIDIA that it infringed copyrights by training NeMo with the dataset. They are seeking unspecified damages on behalf of copyright holders whose works have helped train NeMo's large language model (LLM) over the past three years.


The works involved in the lawsuit include Keene's 2008 novel Ghost Walk, Nazemian's 2019 novel Like a Love Story, and O'Nan's 2007 novel Last Night at the Lobster.


According to foreign media, NVIDIA did not comment on the lawsuit on the day.


Recently, cases of copyright infringement lawsuits against generative AI have been increasing.


Previously, in December last year, The New York Times (NYT) filed a lawsuit against OpenAI, the developer of ChatGPT, and Microsoft (MS), claiming that millions of articles produced by the company were used without permission to train ChatGPT. Additionally, cultural figures including famous writers and comedians, such as George R.R. Martin, the original author of the popular TV drama Game of Thrones, are also engaged in legal battles against OpenAI. In February last year, Getty Images sued Stability AI, a UK-based image generation AI company, for unauthorized use of images.
