Daughter's Extreme Choice Denied Despite Charges

A man in his 50s who forcibly molested his biological daughter, leading her to take extreme measures, has been sentenced to prison.


The Supreme Court's First Division (Presiding Justice Oh Kyung-mi) recently upheld the original sentence of 5 years imprisonment for Mr. A (58), who was charged with forcible molestation within a family relationship.


Mr. A divorced due to domestic violence during his childhood and has a daughter, Ms. B, with his ex-wife. In January 2022, when Ms. B was 21 years old, he invited her by saying, "You are a college student now, so let's have a meal," then took her to his home and is accused of forcibly molesting her.

At the time of the incident, Ms. B refused physical contact, but Mr. A reportedly assaulted her when she resisted and even attempted sexual assault. Ms. B is also known to have submitted an audio recording of the incident as evidence.


However, since Mr. A denied the crime, only the charge of forcible molestation within a family relationship was applied, not rape. In November of the same year, Ms. B left a suicide note stating that she had been sexually abused by her direct ascendant father and took extreme measures.


In the first trial, the court stated, "Most of the facts of the crime are recognized as true, and the mental shock suffered by the victim daughter is severe and unforgivable," but considered "the absence of other sexual crime records and the fact that he was intoxicated," sentencing him to 5 years imprisonment.


Both the prosecution and defendant Mr. A appealed the first trial verdict, but the second trial court upheld the original ruling, stating, "Considering Ms. B's statements during the police investigation, the fact of forcible molestation is recognized."


Mr. A also disagreed with the second trial result. Right after the appellate court's verdict, he reportedly shouted, "I never did such a thing. This is not a trial but a witch hunt," strongly protesting.


Mr. A's side later filed a petition for appeal, but the Supreme Court found no grounds to overturn the appellate court's decision and confirmed the second trial ruling.
