50s Man Sentenced to 9 Years in Appeal Trial for Killing Dementia-Stricken Mother

A son in his 50s who killed his mother with dementia because she could not control her bowel movements was sentenced to a heavy punishment again in the appellate court.


According to the legal community on the 17th, the 1st Criminal Division of the Gwangju High Court (Presiding Judge Park Hye-seon) sentenced A (55), who was indicted on charges of killing a family member, to 9 years in prison, the same as the first trial, and ordered 5 years of probation in the appellate trial.

A was indicted on charges of killing his mother (84), who was suffering from dementia, after becoming angry upon seeing her make a bowel movement mistake between January 22 and 23.


A admitted to strangling her but argued that he had no intent to kill.


The court ruled, "The intent to kill does not necessarily require a purpose or a planned intention to kill," and "The same circumstances do not prevent recognizing the defendant's conditional intent to kill."
