Denied Access Decision Followed by Phone Calls and Visits
A man who was prosecuted for stalking by sending messages through over 100 transfers of 1 won each to his ex-girlfriend's account was sentenced to a fine.
According to the legal community on the 28th, Judge Kim Jae-eun of the Seoul Southern District Court Criminal Division 13 recently sentenced Mr. A, who was charged with violating the Stalking Punishment Act and attempted trespassing under the Criminal Act, to a fine of 4 million won. He was also ordered to complete 40 hours of a stalking treatment program.
Mr. A, after breaking up with his girlfriend Ms. B, whom he had dated for about a year until September last year, sent 1 won each 106 times to Ms. B's account after receiving a text message saying "Do not contact me."
Through the transfer messages, he conveyed words such as "I still love you," "I really wanted to buy you a luxury bag," and "Contact me, I will wait," causing Ms. B to feel anxiety and fear, leading to his prosecution.
Mr. A is also accused of pressing the door lock number of Ms. B's front door or trying to enter her room by opening a window in October of the same year.
Despite receiving a provisional order from the court prohibiting him from approaching or contacting Ms. B, he called her and went to the university she was attending, saying, "Let's talk for just one minute."
The court pointed out, "Considering the specific details, methods, and frequency of the crime, the victim likely felt considerable anxiety and fear," and added, "He repeatedly committed stalking acts even after the provisional order, showing a bad nature of the crime."
However, regarding the sentencing reasons, the court explained, "We considered as favorable factors that he confessed to the crime and that he has no prior criminal record except for a suspended prosecution for another type of crime."
