The Ministry of Justice has overturned the disciplinary actions imposed by the Korean Bar Association (KBA) on lawyers registered with the legal service platform 'Lotoc'.
On the 26th, the Ministry of Justice held a Disciplinary Committee meeting at the Government Complex Gwacheon and accepted the appeals filed by 123 lawyers who were disciplined by the KBA for using Lotoc. Of these, 120 were found not guilty, and 3 received a 'non-disciplinary warning'.
Ino-gong, Deputy Minister of Justice, along with the Legal Affairs Director and external members including judges, participated as disciplinary committee members totaling nine people. Minister of Justice Han Dong-hoon served as the chairperson but did not participate in the deliberations to ensure fairness, following precedent.
Previously, in May 2021, the KBA amended regulations to discipline lawyers who joined platforms such as Lotoc to block the use of legal service platforms. Subsequently, the KBA Disciplinary Committee disciplined 123 lawyers who joined Lotoc between October 2022 and February of this year. The disciplinary measures ranged from the lowest level of reprimand to fines up to 15 million KRW.
The lawyers appealed the KBA's decision to the Ministry of Justice Disciplinary Committee. The Ministry's committee convened three times in total: on July 20, recently on the 6th, and on this day.
