Drunken Person Causing a Scene While Naked Is a 'Minor Offense'... Pedestrian Involved in Dispute Faces 'Assault Charge'

First Trial: 100,000 Won Fine Imposed on All Three Defendants

A man in his 40s who caused a disturbance on the street by picking a fight with passersby and even stripping down to his underwear was fined for a minor offense, while the men in their 40s who committed violence after getting involved in the dispute were each fined for joint assault.

On the 21st, Judge Park Hyunjin of the Chuncheon District Court Wonju Branch Criminal Division 2 announced that A (47), who was charged with violating the Minor Offenses Act, and B (40) and C (45), who were charged with violating the Act on the Punishment of Violent Acts (joint assault), were each sentenced to a fine of 100,000 won.

A was accused of picking a fight with passersby B and C on the street in front of a restaurant in Hoengseong-gun, Gangwon Province, at 12:19 a.m. on November 26 last year. During the argument with B and others, A became angry and stripped off his upper and lower clothes as well as his underwear, exposing his private parts and causing discomfort. B and C, intoxicated, were tried for grabbing A’s arms and pushing him or jointly pushing A’s neck and body multiple times during the quarrel.

Judge Park stated, "Since this was an incident involving all three, punishment was inevitable." Regarding the sentencing, he explained, "However, considering that the defendants all admitted to the crime and do not wish to be punished, and that A was the one who first picked the fight leading to this incident, the sentence was determined accordingly."

Meanwhile, A, who was only fined for the minor offense in this case, was sentenced to 1 year and 4 months in prison in another trial where he was indicted on charges including 11 counts of special injury, special assault, property damage, and obstruction of business.
