Absence from Duty During Probation Period
A social service agent who was absent without leave for 11 days simply because he wanted to rest was sentenced to imprisonment.
The Chuncheon District Court Criminal Division 2 (Presiding Judge Lee Young-jin) announced on the 21st that it sentenced A (23), who was indicted for violating the Military Service Act, to 8 months in prison, the same as the original sentence.
A, who was serving as a social service agent in Chuncheon-si, Gangwon-do, was indicted for being absent without leave for 11 days last June without any particular reason, simply stating that he "wanted to rest."
The first trial court said, "The defendant was sentenced to 1 year in prison with a 2-year probation for violating the Military Service Act in December 2021, and despite being under probation, committed another offense," and sentenced him to 8 months in prison.
The appellate court, which reviewed A's claim of unfair sentencing, stated, "Even considering all the circumstances the defendant raised as reasons for appeal, the original sentence cannot be seen as excessively heavy or unfair," and upheld the sentence.
