Unusual Statement on Lawsuit Against Cohabitant
"Excessive Illegal Acts, Distorted Facts, and Personal Attacks"
No So-young, director of Art Center Nabi, filed a 3 billion KRW damages lawsuit against Choi Tae-won, chairman of SK Group, who is currently undergoing divorce proceedings, and his cohabitant. In response, Choi's side expressed regret, calling it a "very malicious act."
No filed the damages lawsuit the day before at the Seoul Family Court against Kim Hee-young, chairman of the T&C Foundation and Choi's cohabitant.
On the 28th, Choi's side stated in a press release, "No is distorting facts and misleading public opinion again by filing a damages lawsuit while simultaneously distributing pre-prepared materials in an unusual manner."
Choi's side criticized, "These materials are spreading widely not only among the media but also many people, and malicious YouTube channels are preparing to exploit this as good news," adding, "This causes serious infringement on personal dignity and character by making the content appear true to the unspecified public."
They continued, "The damages lawsuit filed by No is legally unwinnable, and even No, who is receiving legal assistance, knows better than anyone that there is no chance of winning in court," adding, "No’s claims are based on a tort damages lawsuit, which becomes time-barred three years after the date the tort was discovered, so it cannot be recognized before verifying the truth."
Choi's side argued, "According to the Supreme Court plenary session ruling, even if the divorce has not been finalized, it is clearly established law that 'after the date the divorce lawsuit is filed, one spouse cannot hold the other’s affair partner liable for tort,'" and "At least from December 4, 2019, when No filed a counterclaim for divorce, the affair itself cannot be established."
They emphasized, "No, who is well aware of the circumstances, suddenly filed this lawsuit during the appeal process five years after filing the divorce lawsuit, not even at the first trial, and indiscriminately distributed a press release that distorted facts. This is a very malicious act intended to distort public opinion and exert pressure and influence on the trial."
Choi's side also stated, "After the first trial verdict, No criticized the verdict based solely on her unilateral claims and distorted facts, even on matters judged in the ruling, through media interviews, implying that the first trial verdict was unjust and did not follow the law," adding, "This misled the general public, who are unaware of the facts, to form incorrect prejudices, and furthermore, she did not hesitate to use aggressive expressions against the first trial judge."
Choi's side explained, "Despite No’s continuous illegal acts related to the divorce lawsuit, we have restrained our response as much as possible to seek an amicable resolution through proper legal procedures," adding, "However, since No has persistently distorted facts maliciously and distributed them to the media after the first trial verdict, repeatedly attacking individuals, irreparable damage has occurred, prompting us to issue this statement."
They concluded, "Considering that this is a personal dispute and a family matter, we strongly request that such illegal and personal attack claims are no longer repeated and that the matter is fairly handled in court."
