Law, fined for public obscenity charges
[Asia Economy Reporter Kim Eunha] A man in his 30s who walked through an apartment corridor with his pants and underwear down, exposing his private parts, was fined. Mr. A claimed that his pants and underwear slipped down after he urinated and that there was no intent of lewd behavior, but the court did not accept this.
On the 18th, the Seoul Eastern District Court Criminal Division 5 (Judge Shin Seowon) sentenced Mr. A, a man in his 30s charged with public indecency, to a fine of 3 million won, ordered him to complete 40 hours of a sexual violence treatment program, and imposed a three-year employment restriction at child and youth institutions as well as facilities for the disabled. The crime of public indecency is punishable depending on whether the exposure occurred in a situation where an unspecified number of people or a small group could see it.
In November 2021, around 7 a.m., Mr. A was performing delivery duties at an apartment in Gangdong-gu, Seoul, when he completely pulled down his pants and underwear to his ankles and lifted his shirt above his stomach, fully exposing his private parts while carrying delivery items through the corridor.
Although no residents encountered Mr. A, his misconduct was recorded on a resident’s personal CCTV. Mr. A noticed the CCTV belatedly and hurriedly pulled up his pants.
The court pointed out that Mr. A was in a situation where he could have met other people and that he should have been fully aware of the lewdness of his actions.
Police investigation revealed that Mr. A was not a regular employee of the delivery company but a family member of a delivery person who had been entrusted with the delivery in a personal capacity.
