In provisional injunction law, Lee Jun-seok wins, but likely dismissed through discretionary ruling
"Legally supports Lee Jun-seok, but politically outcome will favor opposition"
"Discretionary ruling may acknowledge Lee Jun-seok's claim yet decide dismissal"
[Asia Economy Reporter Naju-seok] On the 18th, Cho Eung-cheon, a member of the Democratic Party of Korea, predicted that the injunction request filed by former People Power Party leader Lee Jun-seok regarding the launch of the party’s Emergency Response Committee is "likely to be dismissed." Although legally Lee’s side seems to be correct, it is analyzed that the ruling will consider the party’s autonomy and other factors.
On the same day, Cho appeared on CBS Radio’s ‘Kim Hyun-jung’s News Show’ and said, "Legally, I think there is a high possibility that former leader Lee’s claim will be accepted," but added, "At first, when asked whether this is an emergency situation, they said no." He continued, "Due to procedural defects, such as the resigned Supreme Council members rejoining the Supreme Council meeting for procedural reasons, Lee’s legal claim appears to be correct."
However, Cho said, "Considering that party autonomy is guaranteed by the Constitution even in discretionary rulings, there is a concern that the constitutionally guaranteed autonomy could be seriously infringed upon, so I think there is a high possibility of a discretionary ruling." Regarding this forecast, he added, "Legally, Lee will lose, but politically, he will come out victorious." When asked about the outlook if the ruling goes as Cho expects, he said, "The Emergency Response Committee will continue to operate as it is, but from Lee Jun-seok’s standpoint, it is a political victory," and "(For Lee) legitimacy has been proven."
He also criticized President Yoon Suk-yeol’s remark during his 100-day inauguration press conference the day before, where Yoon mentioned that he "did not have the opportunity to pay attention to other politicians’ remarks" regarding former leader Lee. Furthermore, he praised Lee’s counterattack as "the best quick-wittedness and fighting spirit in the party."
Regarding President Yoon’s comment, Cho said, "Technically, it could be considered a wise response, but considering the low approval rating in the mid-20% range, it cannot be passed off as a typical press conference technique; I think it should have been more honest."
About former leader Lee, he said, "He has the best quick-wittedness and fighting spirit in the party," and added, "Usually, when the opponent is the president and the situation is like this, one waits for the next opportunity, but seeing him respond with a rhyme saying ‘disrespectfully’ made me think he is truly a born fighter." He continued, "He is really gifted," and said, "I don’t think I could do that much myself."
