Integrated Operation of Qualification Review Committee and Disciplinary Committee
[Sejong=Asia Economy Reporter Moon Chaeseok] The regulations will be relaxed to allow certified labor attorneys whose registration was canceled due to becoming an adult ward or bankruptcy to be re-registered immediately upon confirmation that the reasons for reinstatement have been met.
The Ministry of Employment and Labor announced on the morning of the 19th that the partial amendment bill of the "Certified Labor Attorney Act" with this content was deliberated and approved at the Cabinet meeting. The bill is planned to be submitted to the National Assembly within this month.
First, if registration was canceled due to reasons such as being an adult ward, limited ward, or bankrupt person, re-registration will be allowed immediately upon resolution of the reason. This improves the sanction that allowed re-registration only after 3 years from the cancellation date.
Also, for those who received a suspended sentence, a legal basis was established to limit the disqualification period to only the duration of the suspended sentence. Currently, the disqualification period is considered to be 2 years after the expiration of the suspended sentence period.
The amendment also includes integrating the Labor Attorney Qualification Review Committee and the Disciplinary Committee. Additionally, the regulations were strengthened so that even non-governmental members of the committee involved in bribery cases, etc., will be punished.
An official from the Ministry of Employment said, "Through the legal amendment, the government plans to establish an efficient labor attorney system to promote workers' welfare and the sound development of companies, and will continue efforts to improve the system."
