'Adultery Exposure' Woman in Her 60s Fined... "Guilty of Defamation and Other Charges"

[Asia Economy Reporter Kim Daehyun] On October 6 last year, in an office of a company in Chungbuk. Just before lunchtime, Mr. A (65) entered the office, panting heavily. He had come to confront Ms. B (39), who was suspected of being his husband's affair partner. Mr. A caused a disturbance for about 15 minutes and assaulted Ms. B, resulting in injuries requiring one week of medical treatment.
The prosecution indicted Mr. A on charges of injury, obstruction of business, and defamation. At the time of the incident, Mr. A spread out printed materials he had brought on the desk in front of Ms. B's coworkers. The materials included Ms. B's face photo, business card, and exchanged text messages.
Mr. A reportedly said while showing the printed materials, "Look at this, even after seeing this, do you still say you two are nothing?" and "Do you know what this woman did? Why did you go to Namhae with someone else's husband?"
Article 307, Paragraph 1 of the current Criminal Act stipulates that "If a person publicly states facts and damages another person's honor, they shall be punished by imprisonment or detention for not more than two years or by a fine not exceeding 5 million won."
According to the legal community on the 3rd, Judge Nam Shinhyang of the 17th Criminal Division at the Seoul Central District Court recently sentenced Mr. A, who was indicted on these charges, to a fine of 500,000 won.
The court recognized all of Mr. A's charges as guilty. However, it stated, "The crime occurred in a situation where there were sufficient circumstances to suspect the defendant's husband of committing an affair, and the defendant went to confront the victim and the emotions escalated. There are circumstances worthy of consideration regarding the background."
Additionally, the court added, "The degree of Ms. B's injury is relatively minor," and "Considering that the defendant has no prior criminal record and other sentencing conditions, the sentence was determined."
