The Daegu District Court Criminal Division 11 (Chief Judge Sang-oh Lee) announced on the 21st that it sentenced A (53), the CEO of an eyeglass manufacturing company in Daegu, who was indicted on charges of obstructing official duties by deception and bid rigging for submitting false delivery performance records in a bid to the Defense Acquisition Program Administration (DAPA), to 2 years in prison with a 3-year suspension.
B (53), the manager of the same company who participated in the crime, was sentenced to 1 year and 6 months in prison with a 2-year suspension.
Last year, when participating in the qualification screening for combat-use eyeglass contractors issued by DAPA, they submitted electronic tax invoices worth approximately 940 million won, which had never actually been delivered, to the DAPA system in order to inflate their delivery performance evaluation.
The company passed the qualification screening and signed a contract to supply combat-use eyeglasses worth approximately 8 billion won, receiving about 3 billion won as an advance payment.
The court stated, "While strict responsibility must be imposed on the defendants to establish an orderly transaction system for public projects through fair competitive bidding, we have considered that they fully admitted to the crime, showed remorse, and returned all advance payments, resulting in no loss to the national treasury."
