[Asia Economy Reporter Heo Midam] A former baseball player who assaulted an acquaintance while drinking together, causing the acquaintance to suffer an intellectual disability, was sentenced to 1 year and 6 months in prison in the appellate court.


The Criminal Division 1 of Suwon High Court (Presiding Judge Noh Kyungpil) overturned the original sentence of 1 year imprisonment and sentenced former baseball player Moon Mo (39), who was charged with assault causing injury, to 1 year and 6 months in prison on the 4th.


The court stated, "Considering the circumstances leading to this case, the situation at the time, the defendant's attitude after the crime, the extent of the victim's injuries, and the victim's side's petition for severe punishment, the sentence in the first trial is deemed insufficient."


Moon, a former baseball player, was charged with assault causing injury after hitting A (36) in the face during an argument while drinking together at a location in Pyeongtaek, Gyeonggi Province, in March 2018.


Due to Moon's assault, A was diagnosed with traumatic subdural hematoma (a condition where blood accumulates in the brain due to external impact) after hitting his head on the asphalt ground, and it was confirmed that his intelligence declined.


Earlier, the first trial sentenced Moon to 1 year in prison in August of last year.


Subsequently, three months after the first trial, in November of the same year, A's wife posted a message titled "Please clear the injustice of my husband, who suddenly became an intellectually disabled person with an IQ of 55!" on the Blue House National Petition Board, bringing the case to public attention.


In the petition, A's wife stated, "Fortunately, my husband survived thanks to quick surgery, but he had to undergo a craniectomy and a surgery to close the wound without bone, and a few months later, he had surgery to implant artificial bone."


She continued, "Due to that surgery, my husband developed tinnitus in one ear, and although artificial bone was implanted, the shape of his head does not fit well. He suffers from memory loss, slurred speech, a nervous personality, and an IQ level of about 55, which caused him to lose his job, and our family is going through hardship," expressing her frustration.


She appealed, "My husband was diagnosed with an intellectual disability and even received a grade indicating a severe level of disability. Now, he cannot work, and our family, which used to live a normal and happy life, has reached the brink of collapse."


Additionally, A's wife lamented, "We have not received a sincere apology or even medical expenses from the perpetrator," and "We have never seen the perpetrator show any remorse."


The petition, which ended in December last year, received a total of about 189,700 signatures.
