[Asia Economy Reporter La Young-cheol] The Seoul High Court Civil Division dismissed the appeal against the injunction application to suspend the public offering procedure related to the Hangang Riverside Urban Development Project filed against Guri Urban Corporation.
Guri City, Gyeonggi Province, stated on the 20th, "The Seoul High Court (25-1 Civil Division) upheld the first trial's judgment that 'it is difficult to see the act of Guri Urban Corporation refusing to accept the application documents as objectively illegal or as an abuse or deviation of discretion, and there is no other evidence to prove otherwise.'
According to Guri City, Company A, after being refused acceptance on the day of submitting the project plan and other documents last year, filed an injunction application at the Uijeongbu District Court on November 4 last year, seeking to suspend the public offering procedure in this case.
Later, on the 13th of the same month, Company A changed the purpose of the application to request the designation as the preferred negotiation partner and to prohibit the progress of subsequent procedures.
In response, the Uijeongbu District Court (30th Civil Division) judged, "It is clear that the documents submitted by Company A in one large envelope were missing illustrations, and it appears that 20 copies of the project plan were not prepared."
The first trial court also stated, "Company A did not mention at all at the time of submission that 'the remaining documents were being brought to the reception office,' and there is no regulation requiring the debtor to request supplementation. Moreover, the submitted documents are stipulated not to be modified or supplemented," thus dismissing the injunction application to suspend the public offering procedure.
In the appeal trial against this decision, the Seoul High Court also dismissed the claim to "transfer the case to the competent administrative court," stating, "It cannot be regarded as an administrative disposition."
Meanwhile, Mayor Ahn Seung-nam welcomed the court's decision, saying, "All lawsuits filed so far have been dismissed or rejected, and recently, with the extension of the temporary organization in charge of urban development in Gyeonggi Province, an environment is being created where the Hangang Riverside Urban Development Project can gain momentum both domestically and internationally."
The Hangang Riverside Urban Development Project in Guri City officially ended the GWDC project, which had been promoted for over 10 years, in June last year, and is creating a smart complex city over 1.5 million square meters in the Topyeong and Sutaek-dong areas, aiming for completion in 2027.
