Supreme Court Dismisses Election Nullification Lawsuit by Democratic Party's Nam Younghee

Defeated by Yoon Sanghyun in the 22nd General Election by a Margin of 1,025 Votes

Nam Younghee, former Vice Director of the Democratic Research Institute, who lost by a margin of 1,025 votes in the 22nd general election, filed a lawsuit seeking to nullify the election but was unsuccessful.

On January 15, the Third Division of the Supreme Court (Presiding Justice Lee Sukyeon) dismissed Nam's claim in the election nullification lawsuit she filed against the Incheon Michuhol District Election Commission. Election nullification lawsuits are handled as single-instance cases by the Supreme Court.


Previously, Nam ran for the Incheon Dong·Michuhol District B seat in last year's 22nd general election but was defeated by Assemblyman Yoon Sanghyun of the People Power Party by a margin of 1,025 votes. On the day of the election, she raised concerns by requesting a recount of some ballot boxes. Although she later stated that she would accept the results, she filed a lawsuit claiming that the Michuhol District Election Commission violated election administration rules and caused procedural errors by not properly announcing the ballot counting process.


The Supreme Court ruled, "There is no evidence that the defendant obstructed the plaintiff's ballot counting observers from exercising their rights during the opening of ballot boxes or the counting process, nor that the defendant violated the Public Official Election Act regarding the procedures for observing the opening or counting of ballots." The court added, "It is also difficult to recognize that these actions affected the election outcome." Furthermore, the court stated, "There is no evidence to acknowledge that the defendant mixed or counted ballots from other constituencies together with those from this constituency without distinguishing them."


Nam had also narrowly lost to then-independent candidate Yoon in the previous 21st general election by a margin of 171 votes.
