Gyeonggi Province has established new standards for handling civil complaints regarding illegal activities involving commercial cargo trucks, which had previously caused confusion among complainants.
On December 30, Gyeonggi Province announced the "Standards for Handling Civil Complaints on Illegal Acts by Commercial Cargo Trucks," stating that the entire process from complaint submission to administrative action has now been standardized.
Previously, even when complaints about illegal cargo truck activities were submitted through the National Civil Service Portal, each city and county handled them differently, resulting in inconsistent administrative actions for the same violations. For example, "illegal overnight parking" required on-site verification by an official, while other violations under the "Cargo Truck Transportation Business Act" could be penalized immediately without additional verification. Thus, standards varied depending on the type of violation.
To address these issues, Gyeonggi Province clarified the complaint submission method and recognition requirements. Photos taken with the Safety Sinmungo app must include the date, time, and GPS location information, and both the vehicle number and the violation must be clearly visible in the same frame. Complaints must be filed within 48 hours of the violation, and cases referred from other local governments will be processed in the same manner if they meet the requirements.
The standards for each type of violation have also been further detailed. For "illegal overnight parking," at least two photos must be taken at one-hour intervals between 12:00 a.m. and 4:00 a.m. for the violation to be recognized. Even if the requirements are not fully met, the vehicle owner will still receive a warning notice.
For "private vehicles used for paid transport," which are considered a major disruptor in the logistics market, verification of both loading/unloading scenes and transport activities is required as basic conditions. If necessary, confirmation from the company and statements of fact must also be obtained. For "failure to display a transport worker qualification certificate," immediate action will be taken if the certificate is not displayed at the front of the vehicle while driving. However, if the vehicle is stationary, the owner will first be informed of the obligation and then checked for compliance.
For "overloading, failure to secure cargo, or operating with an open cargo bed," immediate administrative action will be taken if there is objective evidence. If evidence is insufficient, the vehicle owner will be notified to encourage corrective action.
Gyeonggi Province has also provided guidance so that any resident can easily file a report using the Safety Sinmungo app. After installing the app, users can select the "Other" category under illegal parking/stopping in the "Report" menu, enter the location where the violation occurred, and submit a photo of the violation to complete the report.
