Four Marine Corps officers who served as on-site commanders during the 'Corporal Chae Incident' have been placed on prosecutorial leave.
On December 22, the Marine Corps announced, "As of today, the on-site commanders indicted in connection with the death of Corporal Chae have been placed on prosecutorial leave, following their indictment on November 10."
Previously, the special prosecutor's team led by Lee Myunghyun, which is investigating the Corporal Chae case, indicted four individuals, including former 7th Brigade Commander Colonel Park Sanghyun, without detention on November 10 on charges of occupational negligence resulting in death or injury.
Prosecutorial leave refers to a measure under the Military Personnel Act, allowing superior officers to place officers or non-commissioned officers on leave at their discretion if they are indicted in a criminal case.
According to the current Military Personnel Act, officers, warrant officers, and non-commissioned officers may be placed on leave if indicted for crimes punishable by death, life imprisonment, or imprisonment for two years or more. Those placed on prosecutorial leave typically receive only 50% of their salary and are not assigned to any post until a final verdict is reached.
