"Special Conditions for Construction Contracts" Revised for the First Time in 14 Years
Recommended Employment Ratio for Yongin Citizens Raised from 50% to 60%
Yongin City in Gyeonggi Province will now require private contractors entering into agreements with the city to assume obligations for safety management and disaster prevention.
On December 1, Yongin City announced that it will revise and implement the "Special Conditions for Construction Contracts of Yongin City," which strengthen the obligations and responsibilities of parties contracting with the city for construction work.
The "special conditions" refer to additional stipulations specified for particular purposes or site-specific circumstances, such as preventing wage arrears and managing subcontractors, beyond the general contract terms. By specifying these conditions in advance for contracts governed by civil law, the city is able to better protect its rights.
This is the first revision of the special conditions in 14 years, since 2011. The city explained that the update was made to reflect changes in the legal landscape, including the Serious Accidents Punishment Act and the Industrial Safety and Health Act, and to ensure smooth execution of construction projects as well as the rightful securing of claims by the client.
Under the revised special conditions, contractors are now required to fulfill safety management and disaster prevention obligations to prevent accidents at construction sites. Accordingly, contractors must implement safety management and disaster prevention measures in accordance with the Serious Accidents Punishment Act, the Industrial Safety and Health Act, and related regulations.
Additionally, through an amendment to the "Ordinance on Supporting the Vitalization of the Local Construction Industry in Yongin City," the city has raised the recommended employment ratio for Yongin citizens from 50% to 60%.
Lee Sangil, Mayor of Yongin City, stated, "We emphasized these issues in the latest revision of the special conditions to prevent accidents at construction sites," adding, "Through continuous institutional improvements, we aim to ensure the smooth progress of public construction projects and minimize contract disputes, wage arrears, and on-site safety management issues."
