"Teacher Does Not Wish to Pursue Charges"... No Referral for Student Accused of Assaulting Teacher

The police have decided not to refer the case of a high school student accused of assaulting a teacher for prosecution.

"Teacher Does Not Wish to Pursue Charges"... No Referral for Student Accused of Assaulting Teacher

On August 18, the Yangcheon Police Station in Seoul announced that they had decided not to refer student A, who had been booked on assault charges in June, for prosecution, citing "no right of prosecution."

This decision was made because the victimized teacher submitted a statement to the police expressing that they did not wish to pursue punishment. Since assault is a crime that requires a complaint from the victim, criminal prosecution is not possible if the victim does not want it.

Student A was accused of striking the teacher in the face on April 10 during class at a high school in Sinjeong-dong, Yangcheon-gu, Seoul, after the teacher pointed out that the student was playing a game on their mobile phone.
