"Over 100-Page Opinion Submitted"
"Careful Review Whether to Indict or Extend Detention"
On July 18, the special prosecution team for the insurrection, led by Cho Eunseok, announced that it had submitted evidence confirming there were no health issues and an opinion statement of over 100 pages to the court for the detention review requested by former President Yoon Seokyeol.
The special prosecution team for the insurrection is expected to emphasize the legitimacy of the detention by mainly involving the special prosecutors and prosecutors who participated in the detention warrant hearing for former President Yoon Seokyeol's detention review. During a briefing that day, special prosecutor Park Jiyoung stated, "Regarding the detention review, we submitted an opinion statement of over 100 pages to the Seoul Central District Court and prepared over 100 PowerPoint slides," adding, "Special prosecutor Park Eoksu, chief prosecutor Cho Jaechul, and three other prosecutors are participating in the detention review."
Regarding former President Yoon's health issues, Park explained, "This morning, we received additional diagnostic documents from Seoul Detention Center stating that there are 'no problems with mobility,' and we submitted these to the court."
Special prosecutor Park further explained, "At this stage, former President Yoon's health issues have not been verified through a hospital, but we have received related documents and facts from Seoul Detention Center, which is managing his detention," adding, "We plan to submit these materials as evidence."
Previously, former President Yoon had refused to attend two insurrection trials and the special prosecution team's third attempt at compulsory summoning, all citing 'health reasons.' His legal representative stated, "Former President Yoon is in such a weakened state that both eating and exercising are difficult."
Regarding the first detention period for former President Yoon, the team stated that, according to standard practice based on the number of days, there are about three days remaining. Since former President Yoon's side filed for a detention review, the investigation of former President Yoon has been suspended.
Special prosecutor Park said, "After the cancellation of former President Yoon's detention, I understand that the prosecution issued guidance to local prosecutors to calculate the period based on the number of days again," and added, "Although we have not received a Supreme Court precedent because no immediate appeal was filed, by standard practice, it appears there are about three days left." He continued, "We will carefully review the case to ensure there are no issues, whether we proceed with indictment or request an extension."
Previously, when former President Yoon was first detained and then released after the cancellation of his detention, the court determined the end of the detention period based on time rather than days. As a result, it was judged that he was indicted after the detention period had expired.
Meanwhile, the Criminal Appellate Division 9-2 of the Seoul Central District Court (Presiding Judges Ryu Changseong, Jung Hyewon, and Choi Bowon) held a detention review hearing for former President Yoon that morning. Former President Yoon appeared in person, but the hearing was conducted behind closed doors and his appearance was not made public.
If the court determines that the detention is unlawful or unjust, former President Yoon will be released. The decision is expected as early as the afternoon of the same day.
