Exit Ban Maintained Even When Investigative Agency Changes

The special prosecutor's team investigating the internal and external affairs related to the 12·3 Martial Law announced that it is currently questioning the former Chief Presidential Secretary for Operations under the Yoon Suk Yeol administration in connection with the Cabinet meeting held during the martial law period.


On July 2, Park Jiyoung, Special Prosecutor, stated at a briefing at the Seoul High Prosecutors' Office, "We are currently questioning Kim Junghwan, the former Chief Presidential Secretary for Operations."


On the day martial law was declared, former Chief Kim received instructions from former President Yoon Suk Yeol to summon additional cabinet members and delivered a list containing the names 'Choi Sangmok, Song Miryung, Cho Kyuhong, Oh Youngju, Park Sangwoo, and Ahn Deokgeun' to former Presidential Secretary for Aides Kang Uigu.

Kim is a former prosecution investigator who served for a long time as a special investigation officer at the Special Investigation Division 1 of the Seoul Central District Prosecutors' Office and other special divisions. Due to his previous working relationship with former President Yoon, he moved to the presidential office after resigning from the prosecution.


Regarding the summoning of Han Ducksoo, former Prime Minister, Ahn Deokgeun, Minister of Trade, Industry and Energy, and Yoo Sangim, Minister of Science and ICT, on this day, Special Prosecutor Park explained, "We cannot disclose specific details or statuses of the investigation, but we are focusing on the authorities, duties, and roles of cabinet members."


She also stated that, in the case of former Prime Minister Han, the special prosecutor's team is maintaining the exit ban imposed during the police investigation phase through a separate exit ban measure.


Special Prosecutor Park explained, "If an exit ban is imposed by the police, and the investigating agency changes, the new agency decides whether to take separate measures. Unless there is a significant change in circumstances, the exit ban imposed by the police is maintained even if the investigating agency changes."


Regarding Noh Sangwon, former Commander of the Defense Security Command, for whom an additional indictment and a request for an additional arrest warrant have recently been submitted to the court, Special Prosecutor Park stated, "The detention period is expected to expire on July 9, so the hearing related to the detention is likely to be scheduled before then."
